A couple may become physically separated. However, they are not deemed legally separated in North Carolina unless one of the spouses obtains a “divorce from bed and board.”

  1. The spouses have lived separate and apart for at least one year, and either spouse has lived in North Carolina for at least six months; or
  2. The spouses have lived separate and apart for at least three years due to one spouse’s incurable insanity.
